PERFORMANCE & LIABILITY DISCLAIMER
(Security Window & Glass Door Film — Supply & Install)

This Disclaimer applies to every quotation, work order, and installation performed by Blackridge Security (the “Contractor”) for security window and glass door films (the “Products”). By approving a quote, paying a deposit, permitting work to begin, or otherwise proceeding with the job, the customer (the “Client”) acknowledges and agrees to the following:

1) Purpose & Scope

The Products are protective films applied to existing glazing. They are supplied and installed as-is to the specifications in the quote. Samples, brochures, and verbal descriptions are illustrative only and do not create additional warranties. Nothing in this section limits non-waivable consumer rights.

2) No Guarantee of Security or Crime Prevention

The Products are a deterrent/delay measure only. They do not make glass unbreakable, bullet-resistant, fire-rated, or intrusion-proof and do not guarantee prevention of forced entry, burglary, theft, injury, or property damage. Results depend on glass type, pane size, frame condition, attack method/duration, exposure, and whether a specified attachment system is included.

3) Moisture Cure & Temporary Appearance (Installation Water)

During installation, solution and squeegee techniques are used to flush out as much water as practicable. Residual moisture inevitably remains within the adhesive layer. The film may therefore appear hazy and may show temporary bubbles or optical moisture pockets as the water evaporates.

  • This condition is normal and not a defect.

  • Typical cure is 30–45 days and may take up to six (6) weeks, depending on temperature, humidity, and sun exposure.

  • If moisture-related bubbles persist beyond six (6) weeks, Client shall notify Contractor for inspection.

4) Tempered-Glass Manufacturing Artefacts (Pre-Existing)

Client acknowledges that tempered glass can contain inherent manufacturing artefacts that pre-date the Work, including roller wave, quench marks/anisotropy (strain patterns), “seeds”/inclusions, tiny pits/marks from dust or debris embedded during tempering, and minor surface distortion. Film application can make these pre-existing features more noticeable due to changes in optical uniformity. These conditions are not caused by the Products or the Work, are not defects, and are not grounds for rejection, price reduction, or warranty claims. Contractor is not responsible for such pre-existing conditions.

5) Inspection & Acceptance Standard

Final viewing is assessed under natural daylight from six (6) feet, perpendicular to the glass, after normal cure. Minor cosmetic artefacts not visible at this standard are not defects. Items attributable solely to normal curing moisture (Section 3) are not defects within the cure window.

6) Limitation of Liability

To the fullest extent permitted by law:
(a) Contractor’s total aggregate liability for any claim relating to the Products or the Work—whether in contract, tort (including negligence), strict liability, or otherwise—shall not exceed the price actually paid for the affected window or glass unit;
(b) Contractor is not liable for indirect, special, incidental, punitive, exemplary, or consequential damages, including theft loss, loss of use, lost profits, business interruption, or diminution in value;
(c) Contractor has no liability where the film is penetrated or punctured during a criminal act or impact event;
(d) Nothing herein excludes liability for Contractor’s wilful misconduct or gross negligence where such exclusion is prohibited by law.

7) Client Responsibilities & Risk Allocation

Client remains solely responsible for overall property security (locks, doors/frames, alarms, monitoring, lighting, and behavior). Client will follow post-installation care (no cleaning/attachments for 30 days, then only non-abrasive methods; avoid impact or sharp tools). Client is responsible for disabling/re-enabling alarms/sensors on glass and for protecting adjacent finishes/furnishings from incidental moisture during installation. Client is responsible for protecting adjacent finishes/furnishings; Contractor is not liable for incidental wetting or contact inherent to installation, except in cases of wilful misconduct or gross negligence.

8) Consumer Protection (Ontario)

For consumer transactions, nothing in this Disclaimer limits non-waivable rights under Ontario’s Consumer Protection Act, 2002. To the extent of conflict, this Disclaimer is read subject to that legislation.

9) Acknowledgment & Incorporation by Reference

By accepting a quote, paying a deposit, or proceeding with the job, the Client confirms they have read and understood this Disclaimer. Each quote/work order incorporates this Disclaimer by reference. The latest version is posted at: https://blackridgesecurity.ca/disclaimer
